Auckland, New Zealand: Menzies Aviation Limited, a key ground-handling provider at Auckland Airport, has been ordered by the Auckland High Court to pay a $150,000 penalty for breaching New Zealand’s Biosecurity Act, following enforcement action by the Ministry for Primary Industries (MPI). The court ruling stems from compliance failures identified at two MPI-approved transitional facilities where Menzies handles imported air freight, containers and associated packaging. Transitional facilities are critical checkpoints where incoming goods are cleared of potential biological threats before entering the domestic supply chain. MPI’s investigation found that on follow-up inspections, six consignments of uncleared risk goods were not properly wrapped in plastic, leaving gaps through which unwanted pests could escape. Inspectors also reported that the primary inspection room did not meet required hygiene standards and was not fit for purpose. Additionally, no biosecurity response equipment was present, and records documenting cleaning and staff training were either incomplete or absent. MPI Regional Manager for Investigations North, Aleshea Allen, emphasised the seriousness of the breach, noting that such failures create “a potential biosecurity risk at our border.” Allen reiterated that all operators handling imported goods are expected to fully comply with mandatory requirements set out under the Biosecurity Act. In announcing the penalty, the High Court highlighted that Menzies had failed to comply with a formal compliance order previously issued by MPI marking the first occasion a pecuniary penalty has been sought under the Biosecurity Act. Although Menzies’ non-compliance was not judged to be deliberate, the court upheld the need for deterrence and accountability. In a statement to the NZ Herald, a spokesperson for Menzies Aviation acknowledged the court’s ruling, noting that deficiencies occurred during a period when staffing challenges persisted in the wake of the COVID-19 pandemic. The company confirmed that corrective measures were implemented well before the court decision and that biosecurity training and processes have since been strengthened. MPI Biosecurity New Zealand Manager Paul Hallett stressed the high stakes of biosecurity compliance, pointing to the risk of invasive pests such as brown marmorated stink bug, ants or moth species all of which have the potential to damage New Zealand’s horticulture and wider economy if inadvertently introduced. Under the Biosecurity Act 1993, corporations can face fines of up to $200,000 for offences related to non-compliance with section 154 obligations, depending on the nature of the breach. The Act forms a central pillar of New Zealand’s border protection system, designed to prevent the introduction of organisms that could threaten indigenous species, agriculture and public health.

The government is now taking new steps to reduce the problem around airports. Deputy Prime Minister and Civil Aviation Minister Viliame Gavoka told Parliament that the airline reported 41 bird strike cases in 2024, compared with 33 in 2023 and 24 in 2022. Four Boeing 737 aircraft were grounded last year after bird strikes, costing the airline about US $19.2 million, while another engine incident this year caused an extra US $4.8 million loss. A major incident took place on October 9, 2025, when Fiji Airways flight FJ450 from Christchurch to Nadi hit a flock of pigeons during take-off. The impact damaged the aircraft’s nose, wings, and both engines. The pilots safely returned to Christchurch Airport. Industry data shows that bird strikes have already cost Fiji Airways more than US $8.4 million in 2024 alone. These costs include repairs, grounded aircraft, and flight delays. Fiji Airports has started a Wildlife Hazard Management Program to stop birds from gathering near runways. This includes mapping bird habitats within five kilometres of airports, using bird deterrent systems, and training airport staff to handle wildlife safely. A new National Wildlife Hazard Management Committee has also been set up to bring together airport operators, environment officials, and local governments. The committee will coordinate actions to reduce bird strike risks across the country. Minister Gavoka said poor waste management, open drains, and fruit trees near airports attract birds. He urged local councils to improve waste control and restrict land use that encourages bird activity. “Safety is our top priority,” Gavoka told Parliament. “We must protect our people and our aircraft from unnecessary danger.” Experts say Fiji’s geography makes bird strikes harder to prevent, as many airports are close to the coast and farmland. Open garbage areas and food waste around Nadi and Nausori airports also draw more birds. Bird strikes usually happen during take-off or landing, when planes are flying low. Even small birds can cause major damage if they hit engines or wings. Authorities are now looking at advanced tools such as bird-detection radar, sound-based deterrents, and public education programs to reduce the risk. Communities living near airports will be asked to help by keeping waste areas clean and avoiding bird feeding near flight paths. Despite the losses, Fiji Airways says safety standards remain high and no passengers or crew have been injured in recent incidents. However, officials agree the issue needs urgent attention to protect both passengers and aircraft.

Indonesia has announced a new directive requiring all international aviation waste entering its territory to be sent back to its country of origin, reinforcing the government’s stance against becoming a disposal site for foreign refuse. The Ministry of Transportation confirmed that waste generated by international flights including cabin trash, catering residues, and cargo packaging must be repatriated and processed under the waste management rules of the originating nation. The regulation is part of Indonesia’s effort to safeguard environmental sovereignty and ensure strict adherence to international waste-control agreements. Officials said the measure is consistent with Indonesia’s commitments under the Basel Convention, which mandates the return of hazardous or non-compliant waste shipments to their source countries. Authorities emphasized that no imported waste, whether by air or sea, should contain hazardous or contaminated materials disguised as recyclables. The government has already begun returning several shipments found to contain dangerous or non-conforming substances. In recent months, containers with toxic and radioactive traces were ordered back to their exporters following inspections at Indonesian ports. Transportation and environment officials stated that detailed technical procedures will soon be issued to guide airlines and airport operators on the handling and return of international aviation waste. These include requirements for proper segregation, containment, and certification before aircraft depart Indonesian airports. The directive is expected to affect international carriers operating into Indonesia, as airlines will now be responsible for ensuring that their onboard waste does not remain within Indonesian jurisdiction. The move also aligns with the country’s broader policy to prevent illegal waste imports and strengthen domestic environmental protection measures.
