Mexico City, Mexico: In a landmark ruling that reshapes the narrative of one of Cuba’s deadliest aviation disasters, a Mexican court has held charter airline Aerolíneas Damojh (Global Air) responsible for the 2018 crash of a Boeing 737 in Havana, concluding that the aircraft suffered from severe maintenance failures and “should never have flown.” The decision, based on court documents dated March 31 and reviewed by multiple international outlets, marks a significant legal departure from earlier findings that attributed the accident primarily to pilot error. An independent expert assessment presented during proceedings determined that the crash of Cubana de Aviación Flight 0972 was an “institutional accident” caused by systemic maintenance negligence. The report emphasized that the pilots were merely the “final line of defense” and were unable to prevent the catastrophe once critical failures had already developed. The judge accepted these findings and ruled that the aircraft’s operator, Global Air, bore responsibility for placing an unfit aircraft into service. The court ordered Global Air to pay USD 1.5 million in compensation to each of the families of the four Mexican crew members who initiated the lawsuit. Notably, the airline failed to appear in court and was tried in absentia, while the aircraft’s insurer also named in the case was ultimately cleared of financial liability. Legal representatives for the plaintiffs described the ruling as “groundbreaking”, arguing that it validates long-standing concerns about the airline’s maintenance practices and operational standards. The accident occurred on May 18, 2018, when a Boeing 737-200 (registration XA-UHZ) crashed shortly after takeoff from José Martí International Airport in Havana while operating a domestic flight to Holguín. Of the 113 people onboard, 112 were killed, making it one of the deadliest aviation disasters in Cuba in decades. Only one passenger survived. The aircraft was owned and operated by Global Air, a Mexican charter airline, and was leased to Cuba’s state carrier Cubana de Aviación under a wet lease agreement. The Mexican ruling directly contradicts Cuba’s 2019 official investigation, which attributed the crash primarily to pilot error and weight miscalculation, citing deficiencies in crew performance and operational procedures. In contrast, the Mexican court concluded that chronic maintenance deficiencies and systemic oversight failures were the root cause, reframing the accident as a broader organizational failure rather than an isolated human error. Global Air had faced prior operational scrutiny in Mexico, including temporary suspension following the crash as authorities examined its compliance with safety regulations. Reports cited during the case highlighted a history of technical issues and complaints, raising questions about the aircraft’s airworthiness long before the accident occurred. Beyond the initial lawsuit, broader legal proceedings are underway. Lawyers representing victims confirmed that: A class-action civil lawsuit covering all victims is in progress A criminal complaint for homicide has been filed against the airline and responsible parties However, the criminal investigation in Mexico has reportedly stalled due to limited cooperation from Cuban authorities. Samuel González, counsel for the victims’ families, described the judgment as a hard-fought and “groundbreaking” decision for Mexico. He said the ruling reinforces early admissions made in Havana by the airline’s own head of maintenance, who acknowledged to relatives that the aircraft should not have been cleared for operation. “That aircraft operated for nearly a decade without proper maintenance,” González said. “The crash occurred in Cuba, but the risk was universal.” Efforts to reach representatives of the airline for comment were unsuccessful. González also indicated that the carrier may be moving toward bankruptcy proceedings, warning that any attempt to misuse the process would be legally challenged.

Suva, Fiji: The Civil Aviation Authority of Fiji (CAAF) has ordered Sunflower Aviation to shut down its operations after the company’s maintenance certificate expired and was not renewed. The Ministry of Tourism and Civil Aviation confirmed yesterday that Sunflower Aviation’s Aircraft Maintenance Organisation Certificate issued under Air Navigation Regulations Part 145C expired at midnight on November 22, 2025, and was not renewed following regulatory findings. According to the ministry, a comprehensive CAAF assessment identified “significant and recurring safety non-compliances,” prompting the regulator to withhold renewal. The ministry said safety remains the Government’s top priority and cannot be compromised under any circumstances. JAG chief executive and managing director Captain Tim Joyce has strongly disputed the Government’s position, labelling the public safety narrative “misleading” and rejecting the claim that Sunflower Aviation posed any risk. He insisted that the issue centred on a technical documentation matter rather than a safety breach, and warned that the decision would unnecessarily affect students, families, and staff. “We respectfully reject the claims and implications contained in the press release and assert that the public was misled about safety risks,” Captain Joyce said. He added that Sunflower Aviation had never operated an unsafe aircraft, nor had CAAF ever issued a finding that any aircraft maintained by the company was improperly released to service. CAAF stood by its determination, stating it acted independently under its legal mandate, and would consider any licence application only after all deficiencies were corrected, verified, and brought into full regulatory compliance. Captain Joyce, however, argued that CAAF’s decision was rooted in its interpretation of a paperwork technicality involving the release-to-service documents of a Cessna 172 used for private flight training at Nausori Airport. He said the aircraft had been cleared by a fully licensed CAAF-approved engineer and remained airworthy. “The minister’s statement omitted the actual grounds claimed by CAAF,” he said. “The decision was based solely on CAAF’s interpretation of a documentation technicality. The aircraft passed all required maintenance procedures and remains fully airworthy. Therefore, the issue is administrative, not a safety concern.” JAG further claimed that the abrupt non-renewal without a show-cause notice, corrective action pathway, or reasonable warning breached basic principles of natural justice, due process, legitimate expectation, and proportionality. The company also criticised the ministry’s public comments, saying they created an inaccurate impression of danger. “The Ministry’s press release wrongly equated a technical dispute with public hazard. No unsafe aircraft were ever operated by Sunflower Aviation, and no finding of that nature exists. The public deserves truthful, evidence-based communication, not vague insinuations of risk,” the group said.

New Delhi, India: India’s aviation regulator, the Directorate General of Civil Aviation (DGCA), has flagged several regulatory and safety management lapses at Akasa Air following a routine surveillance review covering the April–September 2025 period. The authority has directed the airline to undertake corrective action after identifying “systemic failures” across multiple operational domains. The DGCA’s findings point to irregularities in Akasa Air’s flight safety systems, crew duty-time compliance, and internal safety audits. The regulator reportedly observed repetitive procedural lapses and documentation gaps, including delayed closure of internal audit findings and incomplete reviews of cockpit voice and flight data recorder (CVR/FDR) analyses. The regulator also highlighted discrepancies in the alignment of Akasa Air’s Safety Management System (SMS) manual with departmental manuals governing flight operations and engineering. In addition, not all employees had completed mandatory fatigue management training, which forms a critical component of the DGCA’s flight safety oversight framework. Akasa Air, a Mumbai-based Indian airline that launched commercial operations in August 2022. It was founded by Vinay Dube and Aditya Ghosh, with substantial backing from renowned investor Rakesh Jhunjhunwala. The airline began operations on August 7, 2022, with its first flight between Mumbai and Ahmedabad, using a Boeing 737 MAX 8 aircraft. The latest regulatory scrutiny comes as the airline continues its network expansion across domestic routes and prepares for future international growth. In its official response, Akasa Air confirmed that it had submitted detailed explanations and corrective action reports to the DGCA within prescribed timelines. The airline said it remains fully committed to maintaining “the highest levels of operational and safety excellence in line with all regulatory requirements.” Akasa also stressed that such surveillance audits are routine across all scheduled airlines and form part of ongoing safety oversight. While the DGCA has not announced any immediate punitive action, the findings reportedly include Level-II safety observations, a category indicating recurring compliance concerns that warrant close monitoring and formal corrective plans. The regulator has sought a comprehensive Corrective Action Plan (CAP) from the airline, including root cause analyses and steps to prevent recurrence.

Washington, United States: The U.S. The Federal Aviation Administration (FAA) has proposed a civil penalty of $3.1 million against Boeing for what it described as “widespread quality system violations” linked to the company’s 737 production line. The enforcement action covers violations identified between September 2023 and February 2024 at Boeing’s Renton, Washington facility and at Spirit AeroSystems’ plant in Wichita, Kansas. According to the FAA, Boeing presented two aircraft as airworthy for certification even though they did not meet all applicable safety requirements, and in some cases pressured employees to approve work to meet production deadlines. “The safety of the flying public is our top priority, and we will hold Boeing accountable for meeting regulatory standards,” the FAA said in a statement, noting that Boeing has 30 days to respond to the proposed penalty. The proposed fine comes months after a highly publicized incident in January 2024 when a door plug panel blew off an Alaska Airlines 737 MAX 9 shortly after takeoff, forcing an emergency landing. One flight attendant and 7 passengers received minor injuries, the captain, the first officer, 3 flight attendants, and 164 passengers were uninjured and the airplane sustained substantial damage. The event triggered a temporary grounding of MAX 9 jets and intensified scrutiny of Boeing’s quality control processes. A detailed FAA investigation uncovered hundreds of quality lapses, including incomplete documentation, improper inspections, and non-compliant parts. The agency also flagged systemic problems within Boeing’s Organization Designation Authorization (ODA) program, which allows company employees to perform certain certification tasks on behalf of the FAA. Boeing, in its response, said it is reviewing the FAA’s notice and reaffirmed its commitment to strengthening quality oversight,“We have implemented a comprehensive safety and quality improvement plan, including expanded employee training and enhanced supplier oversight,” a Boeing spokesperson said, adding that the company will continue cooperating with regulators. Boeing has until mid-October to formally respond, after which the FAA could negotiate a settlement or pursue enforcement proceedings. Alongside the regulatory action the FAA has approved Type Inspection Authorization (TIA) Phase 2D for Boeing’s 777-9 model, advancing the aircraft’s certification process. This phase includes community noise tests to be carried out in Glasgow, Montana. So far, the 777X test fleet (including the 777-9) has logged over 1,500 flights and nearly 4,200 flight hours. The next major step TIA Phase 3 will include evaluations of the auxiliary power unit (APU) performance and overall stability, although a start date for Phase 3 has not yet been announced. The 777-9 is currently expected to be delivered first to Lufthansa in mid-2026.
