The Central Government informed the court that it had fast-tracked the process of framing rules under the Bharatiya Vayuyan Adhiniyam, 2024, and expected the framework to be finalised within three weeks. The government also placed the draft rules before the bench in a sealed cover, saying that some final discussions were still underway. During the hearing, the Supreme Court of India issued a stern warning over airline compliance. “If airlines are not complying, ground them,” the bench said, according to reports of the proceedings. The observation came after the court was told that airlines were allegedly not complying with directions issued by the government of India concerning fares. The remark does not amount to an immediate order grounding any particular airline; rather, it signals that the court expects the existing regulatory directions to be enforced against carriers that fail to comply. The proposed regulatory framework is being prepared under the Bharatiya Vayuyan Adhiniyam, 2024, which replaced the Aircraft Act, 1934 as the principal legislation governing India's civil aviation sector. The new law came into force in January 2025, while the corresponding rules are being framed to operationalise its provisions. According to the latest reports, the draft rules submitted to the Supreme Court of India address several areas directly affecting passengers. These include airline ticket pricing, surge fares, excess baggage charges and passenger refunds. The broader proceedings also involve concerns over cancellation and refund norms, ancillary charges and the need for stronger protection against arbitrary increases in the cost of air travel. The proposed framework is particularly significant because India's airline market currently operates largely on dynamic pricing, under which fares change according to demand, availability and other commercial factors. The latest government proposal is expected to establish clearer rules governing when and how intervention can take place when fares rise sharply. However, the precise mechanism for controlling surge pricing has not yet been publicly finalized, and reports do not establish that the government has approved a permanent fixed airfare cap. The Supreme Court of India also examined whether the proposed framework would provide an effective regulatory mechanism. After examining the draft placed before it, the bench reportedly questioned whether an effective regulator had been provided for. This issue is significant because the proceedings are not limited to ticket prices; they also concern how passenger-protection requirements will be monitored and enforced once the new rules come into force. For airlines, the immediate position remains that existing government directions continue to apply while the new rules are being finalised. The Central Government of India told the court that the Ministry of Civil Aviation has been issuing office memorandums to airlines concerning pricing during the interim period. The petitioners, however, argued that airlines were not following those directions, prompting the Supreme Court's warning that non-compliant carriers should face action, including grounding. The plea has raised concerns about steep and unpredictable increases in ticket prices, surge pricing, baggage charges, cancellation and refund practices and other ancillary fees. It has also sought stronger regulatory oversight of the aviation sector. The Supreme Court of India has been examining the issue for several months. In earlier proceedings, the court expressed concern over sharp increases in airfares during periods of high demand and sought a mechanism to provide greater predictability and protection to passengers. For passengers, the eventual rules could bring greater clarity to how airlines price tickets during periods of unusually high demand, how additional baggage charges are applied and how cancellations and refunds are handled. For airlines, the framework could introduce clearer compliance obligations and potentially stronger enforcement where government directions are breached. The exact obligations, however, will become clear only after the Central Government completes the rule-making process and formally notifies the final rules. The latest development therefore marks a significant step towards a formal regulatory framework for airfare and passenger-related charges, but it does not yet mean that a new airfare cap or a final surge-pricing formula is in force. New Delhi, India: India’s Directorate General of Civil Aviation (DGCA) recorded 889 serious technical defects during flight operations in 2025, the highest figure in the five-year data released by the Civil Aviation Ministry, with cases rising nearly 28.5% from 692 in 2024. The figures were disclosed by Minister of State for Civil Aviation Murlidhar Mohol in a written reply in the Lok Sabha on August 6, 2026, in response to questions from Congress MP Shyamkumar Daulat Barve. The data showed 514 serious technical defects in 2021, 528 in 2022, 487 in 2023, 692 in 2024 and 889 in 2025. The 2025 total was 197 cases higher than the previous year and about 73% above the 2021 figure. However, the parliamentary disclosure does not provide an aircraft-by-aircraft breakdown of the 889 cases, including aircraft registration, model, airline or the specific technical fault involved. The figures therefore cannot be used to attribute the cases to particular Boeing or Airbus aircraft, engines or aircraft systems. Mohol said the DGCA has established Civil Aviation Requirements (CARs), safety advisories, directives and other regulatory instructions to ensure safe aircraft operations. He said, “For monitoring compliance, DGCA has a systematic safety oversight mechanism encompassing all aircraft and airport operators.” He added, “The safety oversight process includes regulatory audits, night surveillance, ramp inspections, spot checks and special audits. DGCA publishes the Annual Surveillance Plan (ASP) on its website.” The government data also showed that the DGCA took action over safety violations involving airlines and Maintenance, Repair and Overhaul (MRO) operators in 42 cases in 2025, compared with 31 in 2024, 24 in 2023, seven in 2022 and one in 2021. A separate parliamentary disclosure made in July 2025 provides airline-wise technical-defect figures and offers additional context, but it is a different dataset from the 889 serious-defect series. It recorded 183 technical defects reported by scheduled commercial airlines between January 1 and July 21, 2025. Air India and Air India Express together accounted for 85, IndiGo for 62, Akasa Air for 28 and SpiceJet for eight. The earlier data showed 421 technical defects in 2024, 448 in 2023, 528 in 2022 and 514 in 2021. The government said reported defects are investigated and appropriate rectification action is taken. Mohol said, “All defects reported by the airline to the Directorate General of Civil Aviation (DGCA) are required to be investigated for taking appropriate rectification action.” He further said, “The investigation of all defects, particularly major defects, has to be completed expeditiously so as to take preventive/corrective action at the earliest possible.” The government stated that major defects are investigated by the operator in association with the DGCA. The latest available 2026 data provides another indication of the technical issues being reported across Indian aviation, although it should not be added directly to the 889-case five-year series. The Civil Aviation Ministry told the Rajya Sabha on August 3 that 352 “significant technical defects” were reported in domestic and international flight operations between January and June 2026. Of these, 334 related to domestic operations and 18 to international services. Akasa Air accounted for the largest share of the 2026 cases with 152, followed by Air India Express with 53, IndiGo with 47 and Air India with 46. Star Air recorded 29, while SpiceJet and Fly91 reported nine each and IndiaOne Air five. The ministry also said the DGCA issued 382 show-cause notices to airlines for safety violations between January 2024 and June 2026. Separately, the regulator initiated 51 enforcement actions against scheduled airlines between 2023 and 2025 for major violations of safety standards. The measures included financial penalties, suspension of approvals or authorisations and warnings. The government has also reported 2,420 significant technical defects across domestic and international flight operations during the three-year period covered by the latest Rajya Sabha question. That figure, like the 352 cases reported for the first half of 2026, belongs to a separate dataset and should not be combined with the 889 serious defects recorded for 2025. The disclosures show a clear rise in reported technical-defect cases, particularly in 2025, but they do not establish that each case involved a different aircraft or that the defects resulted in an accident, emergency or flight cancellation. The government data available in the cited parliamentary replies also does not provide a fault-by-fault list identifying the aircraft model, registration or affected component for the 889 cases. The figures instead highlight the scale of technical-defect reporting and the DGCA’s enforcement and surveillance activity. The regulator’s stated oversight framework covers aircraft and airport operators through audits, night surveillance, ramp inspections, spot checks and special audits, while airlines are required to investigate and rectify reported defects.

The court has asked the Centre to submit the proposed rules in a sealed cover, even if they have not yet been laid before Parliament, and has listed the matter for further hearing on August 3, 2026. The matter is being heard by a Bench comprising Justice Vikram Nath and Justice Sandeep Mehta, which has repeatedly expressed concern over the lack of regulatory oversight governing airfare pricing and passenger charges. Embraer announced on July 7 that the Directorate General of Civil Aviation (DGCA) has awarded Type Certification to the E190, E195 and next-generation E195-E2. The certification complements the E175, which had already received DGCA approval earlier and is currently operated in India by regional carrier Star Air. With the latest approvals, Embraer's entire first-generation E-Jets lineup, along with the E195-E2, is now certified for operations in the country. A Type Certificate is a mandatory regulatory approval under Rule 50 of the Aircraft Rules, 1937, confirming that an aircraft's design complies with India's applicable airworthiness and safety standards. Without this certification, an aircraft type cannot be commercially operated or sold to airlines in India. The approval follows DGCA's technical assessment of the aircraft and validates their overall design, systems and operational safety. The certification is expected to strengthen Embraer's position as Indian airlines continue evaluating aircraft suited for regional connectivity and thinner domestic routes. The company said the approval enables it to actively market the aircraft to Indian operators while supporting the country's growing demand for right-sized jets between turboprops and larger narrowbody aircraft. Embraer Senior Vice President of Sales & Marketing and Head of Asia Pacific Commercial Aviation Raul Villaron welcomed the approval, thanking the DGCA for its assessment. He said the E-Jets' operating economics, performance and passenger comfort would help reshape regional aviation in India while supporting the Government of India's UDAN regional connectivity programme. According to Embraer, the E-Jets family is designed to bridge the gap between turboprop aircraft and larger single-aisle jets. The aircraft can operate routes that are either too small to justify an Airbus A320 or Boeing 737 or too long for turboprops, allowing airlines to improve network connectivity while maintaining profitability. Regional Vice President of Sales Adity Shekhar said the latest certifications will enable airlines to expand networks and open "blue ocean" routes that were previously commercially difficult to serve. The manufacturer highlighted several operational advantages of the aircraft. The E-Jets can fly sectors of up to seven hours, allowing airlines to connect longer regional and short-haul international destinations. They are also capable of operating from airports with short runways or lower pavement strength, making them suitable for underserved airports across India. Among the newly certified aircraft, the E195-E2 is the flagship model. Embraer describes it as the world's quietest and most fuel-efficient small narrowbody aircraft, offering substantially lower fuel burn and operating costs than previous-generation regional jets while providing improved passenger comfort. These characteristics are expected to appeal to airlines seeking to reduce operating costs while expanding regional capacity. Embraer's global E-Jets programme has established a significant presence since entering service. The manufacturer has delivered more than 1,900 E-Jets worldwide, with the family currently operated by over 80 airlines across more than 50 countries. The aircraft have accumulated millions of flight hours and are widely used on regional and short-haul networks across North America, Europe, Latin America, Africa and Asia. India already represents an important market for the Brazilian manufacturer. Nearly 50 Embraer aircraft across 11 different models are currently operating in the country across commercial, business and defence aviation. Star Air remains the only Indian airline operating Embraer commercial jets, with a fleet of 11 E175 and ERJ145 aircraft serving regional destinations. The certification also comes amid Embraer's broader manufacturing ambitions in India. The landmark exercise was carried out on an IndiGo Airbus A320 at Maharana Pratap Airport in Udaipur, Rajasthan, marking the first time a jet-powered commercial aircraft in India has performed a Localiser Performance with Vertical Guidance (LPV) approach using GAGAN. Until now, satellite-based LPV procedures in the country had been demonstrated only on turboprop aircraft. The successful approach represents a major advancement in India's efforts to modernise air navigation infrastructure by reducing dependence on conventional ground-based landing aids while enhancing flight safety and operational efficiency. Developed jointly by the Indian Space Research Organisation (ISRO) and the Airports Authority of India (AAI), GAGAN is India's Satellite-Based Augmentation System (SBAS). The system improves the accuracy, integrity and availability of GPS signals by transmitting correction data through geostationary satellites, enabling aircraft to conduct highly accurate navigation during all phases of flight, including precision approaches and landings. During the demonstration, the IndiGo Airbus A320 successfully executed an LPV approach, a satellite-guided procedure that provides both lateral and vertical guidance to pilots. The capability allows aircraft to fly stabilised precision-like approaches without relying on expensive Instrument Landing System (ILS) infrastructure installed at airports. Officials said the successful validation demonstrates that GAGAN is now capable of supporting satellite-based approaches for jet aircraft, significantly expanding its operational applicability beyond regional turboprop fleets. The technology is expected to improve safety, particularly at airports lacking advanced ground-based navigation equipment, while also enhancing accessibility during challenging weather conditions and in geographically difficult terrain. Unlike conventional landing systems that depend on ground transmitters such as ILS, GAGAN relies on satellite navigation supported by a network of reference stations that continuously monitor GPS signals and transmit correction information. This substantially improves positioning accuracy and navigation integrity, enabling aircraft equipped with compatible avionics to safely conduct LPV approaches. India joins a small group of countries possessing an operational Satellite-Based Augmentation System, placing it alongside systems such as the United States' Wide Area Augmentation System (WAAS), Europe's European Geostationary Navigation Overlay Service (EGNOS) and Japan's Multi-functional Satellite Augmentation System (MSAS). GAGAN is also the world's first SBAS certified for operations in the equatorial region, where ionospheric disturbances present unique navigation challenges. The latest demonstration builds upon earlier milestones achieved using GAGAN. In April 2022, IndiGo became the first airline in Asia to conduct a GAGAN-enabled LPV landing with an ATR-72 turboprop aircraft at Kishangarh Airport in Rajasthan. The Udaipur exercise now extends the capability to larger commercial jet aircraft, representing an important step towards broader fleet integration. The audit focuses on the capabilities of the regulator rather than the performance of individual airlines. The upcoming review follows what industry observers have described as one of the most challenging periods for Indian aviation in recent decades. Among the major events cited are the fatal Air India Boeing 787 crash in Ahmedabad, multiple helicopter accidents in Uttarakhand, a significant failure of Delhi’s air traffic control systems and the widespread operational disruption experienced by IndiGo in December 2025. The IndiGo disruption, one of the largest airline operational failures witnessed in India, resulted in the cancellation of 2,507 flights and delays to 1,852 services over a three-day period, affecting more than 300,000 passengers nationwide. A DGCA-appointed committee later identified over-optimisation of operations, inadequate regulatory preparedness, software deficiencies and shortcomings in management control as key contributing factors. The FAA review is particularly important because India currently holds Category 1 status under the IASA programme, allowing Indian carriers to operate and expand services to the United States. Retaining that rating is critical for airlines pursuing long-haul growth strategies, including Air India and IndiGo, both of which have announced ambitious international expansion plans. A downgrade could restrict Indian airlines from launching new services or increasing frequencies to the United States until deficiencies are corrected. India previously experienced such a setback in 2014 when the FAA downgraded the country’s safety rating over concerns related to regulatory staffing and oversight capability. The rating was restored after corrective measures were implemented. Government officials have publicly expressed confidence that India will retain its current status. However, industry experts note that the FAA assessment will take place against the backdrop of rapid aviation growth that has significantly increased demands on the regulator. India is currently among the fastest-expanding aviation markets globally, with airlines placing record aircraft orders and passenger traffic continuing to grow. This expansion has intensified concerns regarding inspector availability, surveillance capacity, technical expertise and the regulator’s ability to effectively oversee an increasingly complex aviation ecosystem. Recognising these challenges, the DGCA has initiated a series of corrective measures over the past year. These include enhanced surveillance activities, special safety audits, inspections of airlines and maintenance organisations, and stricter monitoring of airfield operators. Recently, the regulator directed operators of uncontrolled airstrips across the country to immediately review operational conditions and rectify any deficiencies affecting safety. The FAA’s assessment will evaluate multiple elements of India’s aviation oversight system, including aviation legislation, regulatory frameworks, personnel qualifications, technical guidance, certification processes, surveillance programmes and the resolution of safety concerns. The review will determine whether the DGCA possesses the resources, expertise and authority necessary to ensure compliance with international aviation safety standards. The outcome of the November review is expected to be closely watched by airlines, aircraft manufacturers, lessors and international aviation stakeholders. Beyond its immediate impact on air services between India and the United States, the assessment is widely viewed as a test of the strength and maturity of India’s aviation regulatory framework at a time when the country is positioning itself as a major global aviation hub.
