The proposal is being discussed within the Ministry of Civil Aviation and could mark a significant shift in India's aviation policy. Under the existing rules, operators of airports in Delhi and Mumbai are barred from holding more than a 10% stake in any airline. Any relaxation or waiver of the ownership restrictions would require legal clearance from the Law Ministry and approval from the Union Cabinet led by Prime Minister Narendra Modi The potential policy change comes as India's domestic aviation market has become increasingly concentrated around IndiGo and Air India, which together control nearly 90% of domestic capacity. The government is reportedly examining whether allowing airport operators to enter the airline business could bring additional competition and reduce the dominance of the two leading carriers. If the restrictions are eased, the Adani Group, whose airport arm operates Mumbai airport and seven other airports, and GMR Airports, which manages New Delhi airport and four additional airports in India, could potentially establish or acquire airlines. Airport operators that also own airlines could potentially give their own carriers preferential access to prime airport slots, creating a new imbalance in the market. The discussions come against the backdrop of a major consolidation in India's airline industry over the past decade. The collapse of Jet Airways India Ltd. and Go Airlines India Ltd., along with the merger of Vistara and AirAsia India under the Tata Group, has reduced the number of significant competitors in the market. While Akasa Air, SpiceJet Ltd. and smaller regional airlines continue to operate, IndiGo and Air India have emerged as the dominant players. Concerns about market concentration were further highlighted during IndiGo's operational crisis in December, when the airline, which carries more than 60% of India's domestic passenger traffic, cancelled thousands of flights, mainly because of pilot shortages. The country plans to double its number of airports to 350 by 2047, while the International Air Transport Association (IATA) forecasts an additional 425 million passengers by 2044, which would bring passenger numbers to nearly three times their 2024 levels. The proposal could therefore reshape the competitive landscape of India's aviation sector, but it remains at the discussion stage. The court has asked the Centre to submit the proposed rules in a sealed cover, even if they have not yet been laid before Parliament, and has listed the matter for further hearing on August 3, 2026. The matter is being heard by a Bench comprising Justice Vikram Nath and Justice Sandeep Mehta, which has repeatedly expressed concern over the lack of regulatory oversight governing airfare pricing and passenger charges. During earlier hearings, the Bench observed that passengers flying on the same route on the same day often pay vastly different fares despite receiving the same service, raising questions over the transparency and fairness of airline pricing practices. The judges also highlighted the sharp surge in ticket prices during festivals, holidays and emergencies, describing such increases as a matter requiring regulatory attention. The PIL has been filed by social activist S. Laxminarayanan, represented by senior advocate Ravindra Srivastava, seeking comprehensive reforms to strengthen passenger rights. The Centre informed the Supreme Court that the Bharatiya Vayuyan Adhiniyam, 2024 came into force in January 2025 and that the corresponding rules are presently under consultation and translation before being formally placed before Parliament. Embraer announced on July 7 that the Directorate General of Civil Aviation (DGCA) has awarded Type Certification to the E190, E195 and next-generation E195-E2. The certification complements the E175, which had already received DGCA approval earlier and is currently operated in India by regional carrier Star Air. With the latest approvals, Embraer's entire first-generation E-Jets lineup, along with the E195-E2, is now certified for operations in the country. A Type Certificate is a mandatory regulatory approval under Rule 50 of the Aircraft Rules, 1937, confirming that an aircraft's design complies with India's applicable airworthiness and safety standards. Without this certification, an aircraft type cannot be commercially operated or sold to airlines in India. The approval follows DGCA's technical assessment of the aircraft and validates their overall design, systems and operational safety. The certification is expected to strengthen Embraer's position as Indian airlines continue evaluating aircraft suited for regional connectivity and thinner domestic routes. The company said the approval enables it to actively market the aircraft to Indian operators while supporting the country's growing demand for right-sized jets between turboprops and larger narrowbody aircraft. Embraer Senior Vice President of Sales & Marketing and Head of Asia Pacific Commercial Aviation Raul Villaron welcomed the approval, thanking the DGCA for its assessment. He said the E-Jets' operating economics, performance and passenger comfort would help reshape regional aviation in India while supporting the Government of India's UDAN regional connectivity programme. According to Embraer, the E-Jets family is designed to bridge the gap between turboprop aircraft and larger single-aisle jets. The aircraft can operate routes that are either too small to justify an Airbus A320 or Boeing 737 or too long for turboprops, allowing airlines to improve network connectivity while maintaining profitability. Regional Vice President of Sales Adity Shekhar said the latest certifications will enable airlines to expand networks and open "blue ocean" routes that were previously commercially difficult to serve. The manufacturer highlighted several operational advantages of the aircraft. The E-Jets can fly sectors of up to seven hours, allowing airlines to connect longer regional and short-haul international destinations. They are also capable of operating from airports with short runways or lower pavement strength, making them suitable for underserved airports across India. Among the newly certified aircraft, the E195-E2 is the flagship model. Embraer describes it as the world's quietest and most fuel-efficient small narrowbody aircraft, offering substantially lower fuel burn and operating costs than previous-generation regional jets while providing improved passenger comfort. These characteristics are expected to appeal to airlines seeking to reduce operating costs while expanding regional capacity. Embraer's global E-Jets programme has established a significant presence since entering service. The manufacturer has delivered more than 1,900 E-Jets worldwide, with the family currently operated by over 80 airlines across more than 50 countries. The aircraft have accumulated millions of flight hours and are widely used on regional and short-haul networks across North America, Europe, Latin America, Africa and Asia. India already represents an important market for the Brazilian manufacturer. Nearly 50 Embraer aircraft across 11 different models are currently operating in the country across commercial, business and defence aviation. Star Air remains the only Indian airline operating Embraer commercial jets, with a fleet of 11 E175 and ERJ145 aircraft serving regional destinations. The certification also comes amid Embraer's broader manufacturing ambitions in India. The landmark exercise was carried out on an IndiGo Airbus A320 at Maharana Pratap Airport in Udaipur, Rajasthan, marking the first time a jet-powered commercial aircraft in India has performed a Localiser Performance with Vertical Guidance (LPV) approach using GAGAN. Until now, satellite-based LPV procedures in the country had been demonstrated only on turboprop aircraft. The successful approach represents a major advancement in India's efforts to modernise air navigation infrastructure by reducing dependence on conventional ground-based landing aids while enhancing flight safety and operational efficiency. The technology is expected to improve safety, particularly at airports lacking advanced ground-based navigation equipment, while also enhancing accessibility during challenging weather conditions and in geographically difficult terrain. Unlike conventional landing systems that depend on ground transmitters such as ILS, GAGAN relies on satellite navigation supported by a network of reference stations that continuously monitor GPS signals and transmit correction information. The review assumes heightened significance following a turbulent period for Indian aviation, marked by a series of operational disruptions, infrastructure failures and fatal accidents that have triggered concerns over the effectiveness of regulatory oversight in one of the world’s fastest-growing aviation markets. According to reports, the FAA assessment will examine whether the DGCA continues to meet international safety oversight standards established by the International Civil Aviation Organization (ICAO). The audit focuses on the capabilities of the regulator rather than the performance of individual airlines. The upcoming review follows what industry observers have described as one of the most challenging periods for Indian aviation in recent decades. Among the major events cited are the fatal Air India Boeing 787 crash in Ahmedabad, multiple helicopter accidents in Uttarakhand, a significant failure of Delhi’s air traffic control systems and the widespread operational disruption experienced by IndiGo in December 2025. Addressing a press conference on June 20, FIP President Captain C. S. Randhawa disputed suggestions that the Boeing 787's fuel control switches were deliberately moved by the flight crew, stating that “the pilots have actually not moved the switches.” The remarks come amid growing scrutiny of the Aircraft Accident Investigation Bureau's (AAIB) preliminary findings into the June 12, 2025 crash of Air India Flight 171, which killed 260 people shortly after departure from Ahmedabad. The AAIB's preliminary report concluded that both engine fuel control switches transitioned from RUN to CUTOFF shortly after takeoff, resulting in the loss of fuel supply to both engines. Cockpit voice recordings reportedly captured one pilot asking the other why the fuel had been cut off, with the second pilot denying responsibility. According to Randhawa, the report failed to include cockpit warning sequences that would normally accompany a significant electrical malfunction. Randhawa also questioned why investigators allegedly did not give sufficient weight to the testimony of the crash's sole survivor, Vishwash Kumar Ramesh. The decision, approved by the Union Cabinet on June 3, comes as Indian carriers face mounting operational and financial pressure from rapidly escalating fuel costs, which have more than doubled in recent months and threaten to push airfares higher, reduce capacity and impact aviation-led economic growth. The relief package follows a sharp increase in ATF prices caused by geopolitical tensions in the Middle East, particularly the conflict involving Iran, which has disrupted oil markets and raised concerns over supplies moving through the Strait of Hormuz. The strategic waterway handles roughly one-fifth of the world's oil shipments, making any disruption a major concern for global energy markets. As crude oil prices climbed, ATF costs in India surged from around ₹60.50 per litre in March to nearly ₹142 per litre in May, according to government figures. Recent reports indicated that major carriers, including IndiGo and Air India, had already reduced domestic capacity during the June-July travel period in response to soaring fuel costs and operational challenges. Globally, airline executives have also identified fuel costs arising from the Iran conflict as one of the industry's most significant challenges since the COVID-19 pandemic.
