New Delhi: The Directorate General of Civil Aviation (DGCA) has granted medical clearance to an HIV-positive commercial pilot to fly as a commander, but with the condition that he must be accompanied by a more experienced pilot. The pilot has challenged this decision in the Bombay High Court, arguing that the restriction is discriminatory and could hinder his employment prospects.

According to the DGCA, the decision was influenced by concerns regarding the progression of HIV and potential side effects of antiretroviral therapy (ART), which could impact flight safety. The regulatory body cited the International Civil Aviation Organization’s (ICAO) Manual of Civil Aviation Medicine, which outlines risks related to certain medical conditions and their treatment.

The pilot’s legal representatives argue that the DGCA’s condition is unjust, as similarly situated pilots without HIV do not face such limitations. They claim that this restriction effectively makes him unemployable, as airlines may be reluctant to hire a pilot who requires an additional, more experienced pilot on board.

The case highlights the ongoing debate over balancing medical safety regulations with anti-discrimination policies in the aviation industry. The final outcome will likely set a precedent for how medical conditions, particularly HIV, are treated in aviation regulations.
